Introduction
PT Olsera Indonesia Pratama is a limited liability company established and governed under the laws of the Republic of Indonesia, with its registered office in Batam City, Riau Islands Province, Indonesia. Hereinafter referred to as “Olsera” or “We.” A “Customer” is any user of Olsera’s Services, whether an individual, a business entity, or a legal entity subject to the laws of the Republic of Indonesia. Hereinafter referred to as “Customer” or “You.” These Terms and Conditions of Service govern the relationship between PT Olsera Indonesia Pratama and the Customer. Hereinafter referred to as “Terms and Conditions of Service” or “Terms of Service.”
All prospective Olsera customers are required to carefully read and understand these Terms and Conditions of Service. By registering for an account on the website www.olsera.com, you are deemed to have read, understood, accepted, agreed to, and declared your willingness to be bound by the applicable Terms and Conditions of Service.
If the Customer registering the Account is a Representative of the Customer, then such Representative agrees to these Terms and Conditions of Service on behalf of the Customer and warrants that he or she is an authorized Representative of the Customer and therefore has the right and authority to act for and on behalf of the Customer, including but not limited to declaring the Customer’s acceptance of these Terms and Conditions of Service.
General Provisions
Definitions
- An Account is a collection of data from a Customer who has registered to use the Olsera service.
- Service Fees are all types of fees incurred for the use of the Service.
- Features are any conveniences offered by Olsera to Customers through the application.
- Services are products provided by Olsera in the form of Features, technology, products, services, hardware, software, and other products. Services include Accounts, the App, Features, and the POS Service.
- The Point of Sale (POS) Application Service is Olsera’s point-of-sale system product.
- Online Store (Store Website) is a website-based online store system product.
- Mobile Application/Store Application (Store App) is an app-based online store product available on Apple and Android.
- Content refers to information and data provided or uploaded, such as website pages and website services.
- The Site is a web portal owned and managed at the address www.olsera.com.
- A Representative is a user authorized to act on behalf of the store owner.
- A portal is a website that provides a store management page for each registered store.
Account Requirements
A. Account Registration
- You must first register an account on our website to continue using Olsera’s services. Account registration is completed by filling out valid personal information—such as your name, address, email address, and other required details—in the registration form.
- You warrant that the information you provide is your own, and that it is true, accurate, up-to-date, and verifiable.
- If you are registering an Account (“Registrant”) on behalf of an individual, you must be at least 18 years of age or married and have legal capacity. If you are registering on behalf of a business entity or legal entity, the Registrant must be a Representative who is legally authorized to act on behalf of that business entity or legal entity.
- If you are not the store owner or are acting solely as a Representative, you warrant that you have the right and authority to register an Account, use the Services, and act on behalf of the store owner.
- You warrant and agree to be fully responsible for maintaining the security and confidentiality of your account and password. You may provide your Account information to a Representative whom you deem trustworthy, and you are fully responsible for granting such access rights. You release Olsera from any and all claims or lawsuits regarding losses incurred by you or any other party, and you agree to compensate Olsera for any losses it may incur due to the misuse of your Account information and the Olsera Services by your Representative.
- You are required to notify Olsera if you become aware of any security breach, misuse of the Account, or unauthorized or unreasonable use of the Account.
- You must also take the best possible measures as soon as possible to prevent such breaches and/or misuse from continuing. The first step you can take is to reset your password. You agree that Olsera has the right to freeze, block, or terminate your Account and your access to the Services in the event of a breach and/or misuse of the Account in order to maintain the security of the Account.
B. Account Requirements
Account activation takes place immediately after you register your Account, and the Account you register will automatically be assigned the status of “owner.” The “owner” status means you will have the authority to use the Account, access all available Features, and bear full responsibility for all information and content you submit.
C. Use of the Service
- You are responsible for all activities related to the use of the Service, as well as for any information, content, or data—such as graphics, images, and links—uploaded to your Account or your store’s Portal.
- You agree that Olsera may add, remove, or modify Features and functions within the Service as part of updates to the latest version. Customers may use these Features by installing or updating the system to the latest version.
- You agree to use the Olsera Service for the purpose of marketing or selling your products or for other purposes permitted under (i) the Terms and Conditions of Service; (ii) any applicable laws or regulations of the Republic of Indonesia; and (iii) public order.
- The customer agrees and warrants that any content and information uploaded does not constitute goods, services, content, and/or information with negative content, such as:
- Gambling, lottery, and/or betting content;
- Pornography, pornographic services, or items supporting sexual activities, except those permitted for sale under applicable Indonesian law;
- Content that incites hatred against an individual, group, religion, race, ethnicity, age group, or person with a physical disability;
- Content that provides access to narcotics, addictive substances, and psychotropic drugs;
- Goods or services related to bladed weapons and explosives, as well as other items for which there is no license to trade.
- Not authorized for trade in accordance with Indonesian laws and regulations.
- You agree not to engage in, or request others to engage in, any acts of copying, duplicating, distributing, modifying, creating derivative works, reselling, or exploiting any part of the Service, the use of the Service, the source code, or any other content related to the Service.
- You release Olsera from any and all claims for loss or damage that you may incur as a result of modifying or exploiting the Service or the Service’s source code.
- You agree to use the Olsera Service in a reasonable manner. If Olsera determines that the Service has been used in an unreasonable manner or in violation of the provisions of the Terms and Conditions of Service—which may result in a decline in Service performance for the Customer or other Customers, or cause harm to Olsera—Olsera reserves the right to restrict or suspend the use of the Service, accompanied by a verbal or written notice, either in person or via electronic means, to the Customer; and, if possible, Olsera will provide such notice within 1x24 hours prior to implementing the restriction or suspension.
- Customers acknowledge and understand that Olsera’s Services are provided “as is.” Olsera does not guarantee that:
- the Services, information, or products will meet your specific needs and will always meet the Customer’s expectations;
- The Services will be free from interruptions, errors, damage, failures, or theft;
- The Services will always be accurate and reliable;
- The Services provided will always be free from bugs, trojans, viruses, or other harmful software components;
- The Services will meet the Customer’s needs, including but not limited to the availability and compatibility of devices, operating systems, and features.
- To support Olsera’s Services, we include links to websites or content provided or operated by third parties. Olsera is not responsible for any errors, the accuracy of information, defamatory content, deceptive practices, or negative content displayed or linked to by third parties. Olsera and Customers understand that third parties have their own Terms and Conditions and Privacy Policies; therefore, Olsera urges Customers to review the third parties’ Terms and Conditions and Privacy Policies periodically.
- By registering for and using third-party services, the Customer is deemed to have read, understood, and agreed to comply with all Terms and Conditions and Privacy Policies of the third party.
D. Terms of Service
- Point of Sale
- Olsera offers you a selection of devices that can be used with the Olsera POS system. We recommend that you consult with our team before purchasing any device, as not all devices are compatible with the Olsera POS system.
- Olsera is not responsible for any negligence or errors resulting from the purchase of devices without prior consultation with the Olsera team.
- By making a payment for hardware on Olsera, the Customer is deemed to have read, understood, and agreed to the device’s functions, terms, specifications, and usage.
- The Customer agrees that Olsera grants the freedom to purchase devices from other third parties without going through Olsera. Accordingly, the Customer agrees to hold Olsera harmless from any and all losses that may arise from the use of such optional third-party devices.
- Online Store
- You can use all of the standard themes provided by Olsera for your online store website. These standard themes will be updated periodically by Olsera. To consult with us or request a premium, custom, or exclusive theme, please contact our team (send your email to: enquiry@olsera.com). Requests for exclusive themes will incur an additional fee on top of the Service Fee.
- You are permitted to modify the standard theme according to your needs and preferences. Permitted modifications to the theme must be made using the CSS (Cascading Style Sheets) feature. Customers agree to grant Olsera the right to inspect and review such modifications, and Olsera reserves the right to alter or remove such modifications if they contain content or elements that are inappropriate for public display, violate the Terms of Service, Privacy Policy, applicable laws and regulations, intellectual property rights, and so on.
- The intellectual property rights associated with each theme belong to Olsera’s designers. Olsera reserves the right to suspend your store’s active status, close your store, block your account, or take other legal action if you misuse these intellectual property rights.
- Payment Methods
- Olsera’s services provide various payment methods, both those provided by Olsera and those offered in collaboration with third parties. Customers understand that each payment method provided by a third party has its own terms and conditions. By registering, Customers are deemed to have understood and agreed to comply with the terms and conditions imposed by each third party.
- Services
- Payment for Olsera service fees can be made via direct transfer to Olsera’s bank account, through purchases made via Olsera’s official partners, or through a marketplace. Purchases made through a marketplace will be processed in accordance with applicable terms and conditions. - The payment verification process takes up to 24 hours. To expedite the payment verification process, customers can send their receipt or proof of payment along with the store’s URL to the Olsera team.
- By paying the Service Fee, the Customer is deemed to have read, understood, and agreed to the terms of the Service provided. Olsera does not offer refunds or reimbursements of any kind for payments that have already been made.
- Consulting Services
- Olsera provides free consultation services to help you choose a Service package, operate and optimize your use of the Service, and resolve any difficulties you may encounter while using the Service. These consultation services are independent and not affiliated with any third party.
- Customers have the right to decide for themselves whether or not to participate, choose, or use any type of package or offer resulting from their consultation with Olsera.
- Payment and Service Fees
- Payment of Service Fees
- Olsera gives Customers the flexibility to choose the Services they need—whether the Point of Sale system, Online Store Website, or Online Store App—either separately or together. Customers pay Olsera a fee based on the selected package.
- Service fees are billed based on each store’s management website address (URL).
- The service charges in question will be billed (via invoice or notification) automatically via the registered email address within 7 days before the active period ends.
- Customers are requested to make payment for the service charges as soon as possible.
- The mechanism for extending the active period is as follows:
- if the active period has not yet expired, and the Customer makes payment for the Renewal Service Fee, the remaining active period will automatically be combined with the new active period, allowing the customer to continue using the Olsera Service in accordance with the extended active period;
- If the active subscription period has expired and the Customer has not paid the Renewal Fee, Olsera reserves the right to suspend the Account until you pay the Renewal Fee, with a maximum grace period of 30 (thirty) calendar days from the last day of the active subscription period.
- If the payment grace period has expired, Olsera reserves the right to clear or delete the registered Account data at any time without prior notice.
- Olsera reserves the right to calculate, add, or include any additional exclusive fees during the use of the Service that may arise due to requests for additional Service Features, taxes, government regulations, and/or applicable laws and regulations.
- Olsera does not provide refunds for Service packages you have paid for under any circumstances.
- You agree that Olsera reserves the right to make changes to the payment system at any time.
- Payment of Service Fees
- Changes to Payment and Service Fees
- Olsera’s prices or service fees are subject to change at any time based on Olsera’s internal decisions.
- Customers will be notified indirectly of any changes to Service Fees via the website www.olsera.com, email, phone, or text message, or through the store management menu.
- Price changes will only apply to the next Service Fee payment; in other words, Olsera will not charge additional fees for previous Service Fee payments that have already been made.
E. Account Deletion, Cancellation, & Freezing
- Account Cancellation/Deletion
- You may cancel or delete your Account or store at any time after registering it on the Olsera website. Cancellation or deletion of an Account or store can only be performed by the Account owner who registered it and must be done by submitting a request for cancellation or deletion to the Olsera team (email: support@olsera.com).
- The Account owner agrees to provide Olsera with the necessary documents in connection with the request to cancel or delete the Account or store.
- If the cancellation or deletion of a store is carried out before the end of the store’s active period, you are deemed to be aware of and agree that such cancellation or deletion will void the remaining active period of the store and that there will be no refund of any Service Fees already paid.
- The Customer understands and agrees to the consequences of canceling or deleting the store, as follows:
- the revocation or termination of the Customer’s rights to the Account or store pursuant to these Terms of Service;
- Olsera may delete Account/store information and data stored on Olsera’s servers. Olsera bears no responsibility to you or any third party to provide compensation or reimbursement for any losses that may arise in connection with the cancellation or deletion of an Account or store.
- Olsera reserves the right to reject a request to cancel or delete an Account or store if the requester fails to meet the requirements outlined in clauses 1a and 1b of Section E: Account Deletion, Cancellation, and Suspension.
- Account Freezing
F. Deletion of Account/Store Data
- You can delete your account or store data at any time after registering your account and store on the Olsera website. Only the account owner listed as the owner can delete account or store data.
- The deletion of account or store data can only be carried out by submitting a written request for store data deletion to Olsera’s support email. (Support email: support@olsera.com)
- Olsera may delete account or store data as requested by the Customer, and by submitting a request to delete account or store data, the Customer is deemed to have understood and agreed to the possible consequences, such as:
- Deleted account or store data cannot be restored;
- Olsera is not responsible for any errors resulting from the deletion of an account or store requested by the owner;
- Olsera bears no liability to Customers or any third parties to provide compensation or reimbursement for any losses that may arise in connection with the deletion of account/store data.
- Olsera reserves the right to request documents from the Customer as proof of account ownership at any time as needed.
- Customers agree and are obligated to back up, duplicate, recapitulate, store, export, or copy their account or store data before submitting a request to delete such data. Customers agree to hold Olsera harmless from any liability for restoring account or store data immediately after it has been deleted.
- Olsera reserves the right to reject a request to delete account or store data if the requester cannot meet the requirements in points a, b, and d of Section F. Deletion of Account/Store Data.
G. Prohibitions
You agree that you are prohibited from:
- infringe upon the Intellectual Property Rights of Olsera or third parties in connection with the use of the Service;
- using the Olsera Service in a manner that could damage, disable, overburden, impair, or compromise Olsera’s systems or security, or interfere with other Customers;
- accessing or registering using bots or other automated methods;
- circumvent any promotions offered to anyone regarding the Services provided by Olsera;
- copying, duplicating, distributing, modifying, creating derivative works, reselling, or exploiting any part of the Services, the use of the Services, the source code, or any other content related to the Services.
- using the Olsera Service by providing misleading information to third parties or consumers, thereby causing harm to such third parties.
Rights & Limitations of Liability
A. Customer Rights
- The right to choose and use Olsera Services as needed.
- The right to choose and determine the package or device to be used.
- The right to use Olsera Services in accordance with the paid subscription period.
- The right to receive explanations and support regarding the use of the Services from the Olsera team.
- The right to request data queries regarding transaction changes (fraud) via Olsera’s support email. Such requests can only be submitted using the email address registered as the Account Owner.
B. Olsera’s Rights
- The right to modify or discontinue the Service for any reason.
- The right to refuse to provide the Service to anyone for any reason at any time.
- The right (but not the obligation) to remove Store Content/Accounts and/or stores that violate these Terms of Service.
- The right to suspend or terminate the Service in the event of verbal or written harassment, threats of violence, or retaliation against any Olsera employee, member, officer, or management.
- The right to provide Services to anyone, including your competitors, without entering into exclusivity agreements in any specific market segment.
- The right to suspend an Account/store upon expiration of the Service term.
- In the event of a dispute regarding Account ownership, Olsera reserves the right to request documents to determine or verify Account ownership. Such documents may include a business license, ID card, Taxpayer Identification Number (NPWP), and other legal documents. At our sole discretion, we also reserve the right to determine the rightful owner of the Account, and if the rightful owner cannot be determined, Olsera reserves the right to freeze the Account.
C. Limitation of Olsera’s Liability
- Olsera is not liable for any losses that may arise, whether directly or indirectly, unexpectedly, specifically, continuously, or typically, including but not limited to losses due to loss of profits, use, or data, or losses resulting from the Customer’s actions related to:
- Use of the Service or the inability to use the Olsera Service, either in part or in whole;
- Misuse of or unauthorized access to your Account or data;
- Damage or loss resulting from accessing links, including but not limited to damage caused by viruses, spyware, malware, worms, trojans, glitches, bugs, and/or hacking;
- Third-party actions regarding the Service;
- Your violation of these Terms of Service;
- Claims regarding infringement of Intellectual Property Rights;
- Claims arising from unlawful acts;
- Breach or default under any agreement you have entered into with other third parties.
- In any case, you agree to be responsible for all activities involving the use of the Service through your Account. You agree to indemnify Olsera for any losses that may arise from any form of liability, action, legal proceeding, costs, charges, and expenses that Olsera may incur or suffer as a result of the use or misuse of the Service from your Account.
Representations and Warranties
- The Customer agrees to comply with and fulfill the provisions set forth in these Terms of Service in good faith, with the highest level of professionalism, and with a sense of responsibility.
- Customers agree to provide the most accurate and up-to-date information when registering.
Communication
You agree to grant us permission to contact you via email, phone, SMS, or other means to confirm your registration, confirm your use of the Service, or to send you advertisements, marketing materials, and other updates related to the Service through the contact information you provided when registering your Account and/or other contact information you may provide from time to time.
Ownership and Intellectual Property Rights
Olsera grants you, the Customer, a limited, non-exclusive license to use the Olsera Services. No provision of these Terms of Service may be interpreted as a transfer of ownership of intellectual property rights.
A. Intellectual Property Rights & Customer Content
- We respect the intellectual property rights of each Customer regarding content uploaded while using the Olsera Services; therefore, all uploaded content remains the exclusive property of and is the responsibility of each respective Customer.
- By uploading Store Content and making your store public, you agree: (i) to allow others to view, access, and download the Content in your store; (ii) to allow Olsera to access, store, or publish your Content; (iii) to authorize Olsera to review your store’s Content at any time if such a review is deemed necessary; (iv) to upload any Content in accordance with and in compliance with the Terms of Service and applicable laws and regulations of the Republic of Indonesia.
- You agree to grant Olsera, its subsidiaries, and/or affiliates a royalty-free right to use the information and/or data that Olsera obtains through your use of the Service, provided that Olsera notifies you and aggregates and/or anonymizes such information or data before using it.
- You agree to grant Olsera, its subsidiaries, and/or affiliates a royalty-free, non-exclusive, sublicensable right to use, reproduce, modify, adapt, publish, create derivative works from, distribute, perform, and publicly display your Content, provided that such use does not conflict with applicable laws and regulations.
B. Olsera’s Intellectual Property Rights
- All information and data related to the Olsera Service are the exclusive property of Olsera.
- You are not permitted to reproduce, duplicate, distribute, or use the results of work in the form of products and/or services, slogans, images, photos, or the Olsera logo, or to reproduce, duplicate, distribute, or create derivative works of the Olsera Services—including, but not limited to, the source code—for commercial purposes without a written agreement or consent from Olsera.
- You are only permitted to use Olsera Content for legitimate purposes, in a manner that is not misleading, not intended to deceive others, and not in violation of these Terms of Service or the laws and regulations in effect in the Republic of Indonesia. Permitted uses include: introducing, promoting, or providing testimonials to others through any medium. Any use as described above must first be reported to and approved by us.
Changes to the Terms
Olsera reserves the right to make changes, revisions, or updates to these Terms of Service at any time, and such changes will take effect as of the date of publication. Notification of any changes to these Terms of Service will be published on our website or through other media deemed necessary. We urge all Olsera Customers to periodically check this page for any changes as described in the Terms of Service Updates. By continuing to use Olsera’s Services, you are deemed to have agreed to and will comply with the applicable changes to the Terms of Service.
Governing Law & Jurisdiction
These Terms of Service and Privacy Policy are governed by and interpreted in accordance with the laws of the Republic of Indonesia. Therefore, any disputes that may arise in the future will be resolved through consultation aimed at reaching a consensus within a dispute resolution period of 30 (thirty) days from the date of receipt of the dispute notification. If no agreement is reached within that timeframe, the dispute will be resolved by the Indonesian National Arbitration Board (BANI).

- You may ask questions, provide feedback, or submit complaints regarding Olsera’s Services as needed for the following purposes:

- Consultations/Support/Complaints/Questions regarding Service usage: enquiry@olsera.com
- You agree that Olsera has the right to verify and process inquiries, feedback, and/or complaints submitted by Customers, and that Olsera reserves the right to refuse to process any inquiries, feedback, and/or complaints you submit if the data cannot be verified against the Customer data stored in Olsera’s database or based on Olsera’s internal discretion.
